'HOUSE OF MAY BY WENDY SCHEERLINCK' IS OFFICIALLY REGISTERED AS A BRAND IN THE BENELUX AS FROM 15-04-2024.

Article 1: General provisions

The e-commerce and business-to-business website of House of May, a one-man business with its registered office at Ravenakkerstraat 23 - 9310 Moorsel, VAT BE 0862.491.237, hereinafter referred to as 'House of May', offers its customers the possibility to purchase products from its webshop online.

The present General Terms and Conditions ("Conditions") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order through House of May's web store, the Customer must expressly accept these Terms, thereby agreeing to the applicability of these Terms to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded, unless they have been previously, in writing and expressly accepted by House of May.

Article 2: Price

All prices are expressed in EURO and always include VAT and all other compulsory charges or taxes to be borne by the Customer.

If delivery, reservation or administrative costs are charged, this will be mentioned separately. The Customer can also always consult the delivery costs under 'Shipping & Returns'.

The price statement applies exclusively to the articles as word-for-word described. The accompanying photos are intended for decoration and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalog and the e-commerce website are composed with the utmost care, it is still possible that the information is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind House of May. House of May is regarding the accuracy and completeness of the offered information only bound to a means obligation. House of May is in no case liable for obvious material errors, misprints or printing errors.

If the customer has specific questions about e.g. sizes, color, availability, delivery time or delivery method, we request that the customer contacts us in advance at info@houseofmay.be or by phone at +32 (0)477 599 297.

The offer is always valid while stocks last and can be modified or withdrawn by House of May at any time. House of May cannot be held liable for the unavailability of a product. If an offer has a limited validity or is made under conditions, this will be explicitly mentioned in the offer.

House of May always tries to depict the colors of all articles truthfully. Keep in mind that the colors on a computer screen and the ambient light do not always correspond to reality. There may always be small color differences compared to reality.

For the sizes we refer to the product descriptions. Where possible you can also count on the assistance of House of May, both by mail and by phone.

Article 4: Online purchases

The ordering procedure through the webshop is as follows:

- You choose the desired products from the webshop where you select the number of pieces and if applicable, the color and size. Then press the button 'add to cart'.

- If you wish to pay for your purchase, press the shopping cart button at the top right. You can now choose 'checkout' or change the amount of the item(s) in your shopping cart first, before choosing to go further with the checkout process. The total price will be updated immediately after changing any of the amounts.

- On the 'checkout' page we ask you to fill in your details. As a Belgian individual, you will not receive an invoice. As an individual outside the borders of Belgium, you will always receive an invoice. If you wish to ship to an address other than yours, you can also specify this here. We ship to any address within Belgium, the Netherlands, Portugal, Italy, Austria, Spain and Luxembourg. The shipping cost will be automatically calculated at check-out depending on the chosen destination country. Free pickup in our studio in Belgium is also possible! Finally, you can also add a note. Also choose the desired payment method and approve the terms and conditions. Press 'Purchase' to complete your order.

- For pickup, please contact us on +32 477 599 297 to find the best moment. Or write an email to info@houseofmay.be. Pickup for artworks is not possible.

- Do you wish to order as a company? Please contact us first, before placing any order.

- Are you based in another country than the ones we deliver to? Do contact us and we’ll see what we can do.

- Before finishing your purchase you can choose to create an account for faster checkout, but it’s not obligatory.If you are interested in making an account you’ll have to add a password of at least 10 characters. You can also choose to remember your payment information.

- After confirming your order with the ‘Purchase’ button, an order number will appear immediately. A confirmation of your order will also be sent automatically to the e-mail address you provided. At this point, completely without obligation, you have another opportunity to create an account.

- You will also receive an email when your order is fulfilled and sent out.

- after your order has been processed, you will also receive a tracking page (via e-mail) with which you can follow the delivery of your order yourself.

The Customer has the choice between the following payment methods:

- by Visa

- by Master Card

- by American Express

- via Paypal or Venmo

- via Apple Pay

- via Google Pay

House of May is entitled to refuse an order due to a serious shortcoming of the Customer regarding orders involving the Customer.

Safe payment (secure SSL connection) via Visa, Master Card, American Express, Paypal, Venmo, Apple Pay or Google Pay.

As soon as the payment is in order, we or our print supplier starts preparing the order.

Article 5: Delivery and execution of the agreement

Shipping rates and countries of delivery can be found under 'Shipping & Returns'.

Orders can be delivered to your home or work address.

For more information about the delivery methods and the follow-up of the delivery, we refer to 'Shipping & Returns'.

If the Customer requests a method of delivery that differs from the method applied by us, any additional costs will be charged to the Customer.

Information on processing and shipping times can also be found under 'Shipping & Returns'.

You can always follow the expected delivery date(s) via the tracking page received.

Customers may cancel free of charge if, for any reason, goods cannot be delivered within 30 days of the conclusion of the agreement, in accordance with Article VI.43 of the Economic Code. (art prints excluded, because printed on demand)

Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery, must be reported by the customer to House of May immediately and within 2 calendar days.

We are not liable for damage, loss or other problems during shipping. (except for damaged or lost art prints)

Please also be sure to provide your information to us completely and correctly, incorrect delivery addresses are the responsibility of the Customer and may result in additional costs that are borne by the Customer.

The risks of loss and damage to the goods are transferred to the Customer at the time of delivery or collection. However, if the Customer fails to comply with its contractual obligations, the risk of loss and damage to the products shall pass to the Customer at the time when delivery should have taken place without any breach of obligations on the part of the Customer.

Article 6: Retention of title

The delivered articles remain the exclusive property of House of May until the moment of full payment by the customer.

The customer undertakes, if necessary, to draw the attention of third parties to the retention of title of House of May, e.g. to anyone who might come to seize the articles that have not yet been paid for in full.

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who, in their capacity as consumers, purchase items online from House of May.

The Customer has the right to withdraw from the contract within a period of 14 calendar days without giving any reason.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the last good.

To exercise the right of withdrawal, the Customer must inform House of May, located at Ravenakkerstraat 23, 9310 Moorsel, and reachable via cell phone +32 (0)477 599 297 or e-mail info@houseofmay.be , of its decision to withdraw from the agreement via an unequivocal statement (e.g. in writing by post or e-mail).

To comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to House of May, Ravenakkerstraat 23, 9310 Moorsel, without delay, but in any event no later than 14 calendar days after the day on which he communicated his decision to withdraw from the contract to House of May. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct cost of returning the goods shall be borne by the Customer.

The Customer is requested to return the items in their original condition and packaging, with all accessories, and instructions for use included. If the returned product is in any way impaired in value, House of May reserves the right to hold the Customer liable and claim damages for any impairment of the value of the goods resulting from the Customer's use of the goods beyond what is necessary to establish the nature, characteristics and operation of the goods.

All returned items will be carefully examined. The basic premise here is that the Consumer may only inspect the item as they would be permitted to do in a retail store. Returned items may be tried on, but must not have been used. If an article has undergone a reduction in value due to the Customer's use, this will be charged to the Customer.

If the Customer cancels the contract, House of May will refund all payments received from the Customer up to that point, including standard delivery charges, to the Customer within a maximum of 14 calendar days after House of May has been informed of the Customer's decision to cancel the contract. In the case of sales contracts, House of May may wait to refund until it has received all the goods back, or until the Customer has demonstrated that it has returned the goods, whichever comes first.

Any additional costs resulting from Customer's choice of a method of delivery other than the cheapest standard delivery offered by House of May will not be refunded.

House of May will refund the Customer using the same means of payment with which the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged for such refund.

The Customer may not exercise the right of withdrawal for the delivery of goods manufactured to the Customer's specifications, printed on demand or which are clearly intended for a specific person.

Article 8: Guarantee

Under the Act of September 21, 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must contact info@houseofmay.be and return the item to House of May at their expense.

If a defect is found, the Customer must inform House of May as soon as possible. In any case, each defect must be reported within a period of 2 months after its discovery by the customer. Afterwards every right to repair or replacement expires.

The (commercial and/or legal) warranty is never applicable to defects caused by accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the user instructions or manual, adaptations or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that become apparent after a period of 6 months following the date of purchase, or delivery if applicable, are not considered to be hidden defects, unless proven otherwise by the Customer.

Any complaints can be addressed to this address. We will try to handle your complaint within 7 days.

Article 10: Penalties for non-payment

Without prejudice to the exercise of other rights available to House of May, in the event of non-payment or late payment, the Customer shall be liable, ipso jure and without notice, to interest of 10% per year on the unpaid amount from the date of the default. In addition, the Customer shall be liable, by operation of law and without notice, to pay a lump-sum indemnity of 10% on the amount in question, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, House of May reserves the right to take back articles that have not been paid for (in full).

Article 11: Privacy

The controller, House of May, respects the Belgian law of December 8, 1992 regarding the protection of private life in the processing of personal data.

Article 12: Use of cookies

During a visit to the site, "cookies" may be placed on your computer's hard drive. A cookie is a text file that is placed by a website's server in your computer's browser or on your mobile device when you consult a website. Cookies cannot be used to identify individuals, a cookie can only identify a machine.

Article 13: Invalidity - non-waivers

If any provision of these Terms and Conditions is declared invalid, unlawful or void, this will in no way affect the validity, legality and applicability of the other provisions.

The failure at any time by House of May to enforce any of the rights enumerated in these Terms and Conditions, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall not affect the validity of such rights.

Article 14: Amendment of terms and conditions

These Terms and Conditions are supplemented by other terms and conditions expressly referred to, and the general conditions of sale of House of May. In case of contradiction, these conditions prevail.

Article 15: Proof

The Customer accepts that electronic communications and backups may serve as evidence.

Article 16: Applicable law - Disputes

Belgian law shall apply, with the exception of the provisions of private international law on applicable law.

The courts of the Consumer's place of residence have jurisdiction in the event of legal disputes. The Consumer may also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
